This is a Nokia Lumia 520, like new condition. AT&T Carrier.

-It is in perfect working condition. No scratches, no cracks, nothing is wrong with it. It comes with the original charger.
The outlining you see in the pictures on the screen is the screen protector, so any scratches you see are on it.

-It has been upgraded from Windows 8 to Windows 8.1, although when I reset it to factory settings when it ships out, I am unsure if it will keep 8.1, if not you can simply upgrade OTA(over the air from phone) yourself.

You need a code to unlock it. You could possibly contact AT&T and request the unlock code for this model. Otherwise, you could pay online to various websites/dealers that provide a code, for a fee.
