Brand new. Only been opened and put in Wii once. Since my Wii is not upgraded(and wont be upgraded) It has not been played. Still have receipt as well.

Nope not scratched. Dont think i can do GIN since some one already bid but can look. As stated it has NOT been played. Since i dont want to update my Wii i can not play this. Since its been opened the policy of the store is to give another game which wouldnt do me any good.

Regular System Update. But because my Wii is Softmoded i dont want to mess it up and do the update from Nintendo.
